But that's not murder - what do you think that guy was going to do with his pipe? Give him a shiatsu massage with it? Even if it weren't a mugging (which it clearly was), the guy had every reason to believe he was in danger (even if that was only apparent after the fact).
But, no, he should go to jail right? God forbid somebody should take it upon himself to protect his own life and property, only The State™ has the right to help you, and if they can't then you should just get used to being murdered.
