Ebauman's site makes a profit based on the content he steals. Even if max made huge amounts of profit, he wouldn't be considered a thief because the users of his site submit the material. Not giving credit on a YTMND is not stealing because, no matter what, the person submitting uncredited (or credited for that matter) material will never see a dime. Eric Bauman on the other hand, is literally stealing, while the creator of the YTMND in question, is merely being rude in not giving credit where credit is due
